1. Introduction

These Terms and Conditions govern the use of this website and the services provided by Digital Alchemist operated by Carla Arrowsmith, a freelance web designer and developer based in Wales, UK. By using this website or engaging my services, you agree to be bound by these Terms and Conditions.

2. Services

I provide web design, web development, branding, website maintenance, and related digital services. All services are provided on a freelance basis and are subject to availability and agreed scope.

Any work carried out will be based on the requirements agreed in writing (email, proposal, or contract). Changes outside the agreed scope may incur additional costs.

3. Quotes & Pricing

All prices are quoted in GBP (£) unless otherwise stated. Quotes are valid for 14 days unless specified.

One-off fixes, maintenance, or support tasks are quoted based on complexity and estimated time. Final pricing may change if the scope of work changes after work has begun.

4. Payment Terms

Payment terms will be agreed before work begins.
Unless otherwise stated:

  • Full payment may be required upfront for smaller projects
  • Larger projects may require a deposit before work starts
  • Invoices must be paid within 7 days of issue

Late payments may result in work being paused until payment is received.

5. Revisions & Amendments

Reasonable revisions are included where agreed as part of the project scope. Excessive revisions or changes outside the original brief may be charged at an additional rate.

6. Client Responsibilities

You agree to:

  • Provide accurate and timely content, assets, and feedback
  • Ensure you have the rights to any content you supply
  • Review and approve work within a reasonable timeframe

Delays in providing content or feedback may affect project timelines.

7. Intellectual Property

Unless otherwise agreed:

  • Final designs and websites become your property once full payment has been received
  • I retain the right to display completed work in my portfolio and for promotional purposes

Third-party assets (themes, plugins, fonts) remain subject to their original licences.

8. Website Maintenance & One-Off Fixes

For one-off maintenance or bug fixes:

  • No guarantee is given that all issues can be resolved if caused by third-party software, hosting, or plugins
  • I am not responsible for issues arising after work is completed unless covered by a separate maintenance agreement

Backups are recommended before any updates or fixes.

9. Limitation of Liability

I will not be liable for:

  • Loss of data, revenue, or business arising from website use
  • Downtime caused by hosting providers or third-party services
  • Issues caused by software updates, plugins, or themes not developed by me

My liability is limited to the amount paid for the service provided.

10. Termination

Either party may terminate services with written notice. Any work completed up to the termination date must be paid for in full.

11. Third-Party Services

I may recommend or integrate third-party tools or services. I am not responsible for their performance, availability, or changes to their terms.

12. Privacy

Your personal data will be handled in accordance with my Privacy Policy. I will never sell or misuse your information.

13. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

I reserve the right to update these Terms and Conditions at any time. The latest version will always be available on this website.
